Privacy Notice

1.Introduction
This manual is published by Clark & Co Attorneys ("the Firm", "we", "us") in accordance with section 51 of PAIA, and incorporates our POPIA privacy notice in line with the Information Regulator's guidance permitting these disclosures to be combined into a single document. It explains what records we hold, how to request access to them, and how we collect, use and protect personal information.
2.About Clark & Co Attorneys
Clark & Co Attorneys is a property law practice led by founder and attorney Angela Clark (LPC Enrolment No. F75989), an admitted attorney of the High Court of South Africa, specialising in conveyancing, corporate and commercial law, and dispute resolution, with offices (by appointment) in Johannesburg, Cape Town and Durban.

4.Guide on how to use PAIA
Section 10 of PAIA requires the South African Human Rights Commission (SAHRC) to publish a guide, in each official language, containing information to assist a person wishing to exercise a right of access to records. That guide is available from the SAHRC at www.sahrc.org.za, or by contacting the SAHRC directly. This manual should be read together with that guide.
5.Records held by the Firm
5.1 Records available without having to submit a formal request
- General information about the Firm, its practice areas and personnel, published on our website

- This PAIA manual and POPIA privacy notice
5.2 Records available only on submission of a formal request
- Client matter files, instructions, correspondence and documents relating to conveyancing, corporate/commercial or dispute resolution matters
- Trust account and financial records
- Title deeds, sale agreements, bond and transfer documentation held in connection with a specific matter
- Company and entity governance records held on behalf of clients
- Billing, invoicing and accounting records
- Records relating to employees, contractors and the Firm's consulting network
- Website and client enquiry records, including information submitted via our contact form
Access to some of these records may be limited or refused on the grounds set out in Chapter 4 of PAIA, which include, among others, legal professional privilege, the protection of a third party's personal information, and commercially sensitive or confidential information.
6.How to request access to a record
A request must be made on the prescribed form (Form 2 under PAIA), addressed to the Information Officer at the contact details in section 3, and must provide sufficient detail to enable the record to be located, together with proof of identity.
The following fees currently apply to a request made to a private body, as prescribed by the Regulations to PAIA (correct as at the date of this manual and subject to change - please confirm current amounts with us or the Information Regulator before relying on them):
- Request fee: R140.00 per request
- Photocopies / printed black-and-white copies: R2.00 per page or part thereof
- Computer-readable copy on a flash drive or CD supplied by the requester: R40.00
- Copy on a CD supplied by the Firm: R60.00
- Transcription of an audio recording: R24.00 per A4 page
- Search and preparation: R145.00 per hour (or part thereof), excluding the first hour, capped at R435.00 per request
- A deposit may be required where search and preparation is expected to exceed six hours
We will respond to a valid request within 30 calendar days, extendable by a further period in the circumstances permitted by PAIA, and will notify you in writing of the outcome.
7.Internal remedies and the Information Regulator
If a request is refused, if you are unhappy with how your request was handled, or with how your personal information has been processed, you may lodge a complaint with the Information Regulator:
8.POPIA privacy notice - how we process personal information
8.1 Responsible party
Clark & Co Attorneys is the responsible party for personal information processed in connection with our services and our website.
8.2 What we collect and why
Client and matter information. We collect personal information necessary to open and conduct a client matter (such as identity, contact, financial and property details), including information required to comply with FICA and other regulatory obligations. This is necessary to perform our mandate and to comply with our legal obligations.
Website enquiries. If you contact us through our website, we collect the name, contact details and message content you choose to submit, in order to respond to your enquiry.
Conveyancing calculator. Our conveyancing cost calculator runs entirely in your browser. The figures you enter are not transmitted to or stored by Clark & Co, and are used only to display an estimate to you.
8.3 Sharing of information
Depending on the matter, we may need to share relevant personal information with third parties such as the Deeds Office, SARS, financial institutions, correspondent attorneys, other parties to a transaction and their representatives, and the specialist consultants within our network who are engaged on a matter - always limited to what is necessary for that matter.
8.4 Cross-border transfers
We do not routinely transfer personal information outside South Africa. Where a specific matter requires this, we will only do so in accordance with the conditions set out in section 72 of POPIA.
8.5 Retention
We retain client and matter records for the period required by our professional and statutory obligations as attorneys, and website enquiry information for no longer than is necessary to respond to and resolve the enquiry.
8.6 Security
We take appropriate technical and organisational measures to protect the personal information in our possession against loss, unauthorised access and misuse.
8.7 Your rights
Subject to POPIA, you have the right to: be notified of the processing of your personal information; access the personal information we hold about you; request correction or deletion of your personal information; object to the processing of your personal information in certain circumstances; and lodge a complaint with the Information Regulator (contact details in section 7).
To exercise any of these rights, please contact our Information Officer using the details in section 3.
9.Information Officer registration
In terms of POPIA, Angela Clark acts as the Information Officer of Clark & Co Attorneys. Registration of this appointment with the Information Regulator is in progress.
